Indianapolis, Indiana - James Bopp, Jr., of The Bopp Law Firm, PC, testified in front of the Indiana Senate Corrections and Criminal Law Committee on Tuesday that House Bill 1235 should be passed. The bill would prevent Gary, Indiana, from continuing a lawsuit intended to prohibit the sale of firearms throughout the State of Indiana.
In 1998, Gary sued major firearm manufacturers and distributors to hold them liable for any firearm sales, lawful under Indiana state law, when the firearms are misused by criminals causing injury or death. This lawsuit, if successful, would mean that it would be illegal to sell lawfully purchased firearms in the State of Indiana since they might be used to commit a crime and would ultimately prevent law-abiding citizens from purchasing weapons to protect themselves.
HB 1235 would give the power to file lawsuits against firearm manufacturers and distributors to the Attorney General of Indiana. This would eliminate patchwork and partisan lawsuits against these manufacturers but would still leave an avenue for the Attorney General to sue these manufacturers for any unlawful conduct.
“Gary is trying to set gun policy for the entire State of Indiana based on a lawsuit that has gone on for a quarter of a century and simultaneously is seeking the records of hundreds of thousands of legal gun purchasers,” said Attorney Bopp.”This has to stop and HB 1235 will stop it.”
